More Counties Move to Yellow Phase on May 15, 2020

Governor Wolf issued an Amendment to the Initial Yellow Phase Order. The Amendment adds 13 counties to the list of Yellow Phase Counties. Briefly, it must be noted that moving from Red to Yellow does not lower the burden on employers to ensure that their workplaces are safe for the employees. Recent cases throughout the country provide a glimpse into what future COVID litigation will look like. These cases are based in principles of negligence and include causes of action such as wrongful death. Employers who do not promulgate and implement COVID Safety policies risk horrendous exposure to liability.

The following counties have entered the Yellow Phase:

  • Allegheny

  • Armstrong

  • Bedford

  • Blair

  • Butler

  • Cambria

  • Fayette

  • Fulton

  • Green

  • Indiana

  • Somerset

  • Washington

  • Westmoreland

It is crucial that businesses set up a COVID Plan to protect employees and assets.
